{"id":6947,"date":"2025-04-10T13:54:55","date_gmt":"2025-04-10T18:54:55","guid":{"rendered":"https:\/\/toxinfreeusa.org\/?p=6947"},"modified":"2025-04-10T13:58:22","modified_gmt":"2025-04-10T18:58:22","slug":"gmo-toxin-free-usa-sues-perfect-day-alleging-misleading-claims-about-animal-free-dairy","status":"publish","type":"post","link":"https:\/\/toxinfreeusa.org\/gmo-toxin-free-usa-sues-perfect-day-alleging-misleading-claims-about-animal-free-dairy\/","title":{"rendered":"GMO\/Toxin Free USA Sues Perfect Day Alleging Misleading Claims About \u201cAnimal Free Dairy\u201d"},"content":{"rendered":"\n<p>WASHINGTON, April 10, 2025 &#8212; Nonprofits GMO\/Toxin Free USA and Organic Consumers Association filed a lawsuit against Perfect Day, Inc., alleging material omissions and deceptive marketing of its genetically engineered synthetic \u201cdairy\u201d product, ProFerm.<\/p>\n\n\n\n<p>The product, ProFerm, is a bioengineered \u201cwhey protein\u201d used by brands such as Bored Cow Animal-Free Dairy Milk and Myprotein Whey Forward Animal Free Protein. ProFerm is made using synthetic biology (synbio) genetic engineering. The industry describes the process as \u201cprecision fermentation.\u201d<\/p>\n\n\n\n<p>Perfect Day and brand partners market ProFerm as safe, sustainable, identical to cow-derived whey protein, capable of creating milk identical to cow\u2019s milk including its nutritional profile, and free from GMOs.<\/p>\n\n\n\n<p>Health Research Institute (HRI), an accredited, public-interest laboratory, analyzed ProFerm and a related product, along with certified-biodynamic and certified-organic whole cow\u2019s milk.<\/p>\n\n\n\n<p>HRI\u2019s findings illustrate that representing ProFerm as the same as cow\u2019s whey or capable of creating milk \u201cidentical to traditional milk\u201d is false and misleading because:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ProFerm is only 13.4% cow\u2019s whey protein.<\/li>\n\n\n\n<li>86.6% of ProFerm proteins are fungal proteins.<\/li>\n\n\n\n<li>ProFerm contained 93 fungal compounds not found in cow\u2019s whey.<\/li>\n\n\n\n<li>The fungal proteins and compounds are unknown to science, have never been part of the human diet, and are by-products of the GMOs used in the fermentation process.<\/li>\n\n\n\n<li>\u201cMilk\u201d produced with ProFerm contains a fraction of the nutritional value of cow\u2019s milk, missing 69 nutrients and containing no omega 3, fatty acids, or vitamins B2, B5, and E.<\/li>\n<\/ul>\n\n\n\n<p>ProFerm and products made from it are not even remotely similar to cow\u2019s whey or milk.<\/p>\n\n\n\n<p>By HRI\u2019s assessment, the novel compounds and proteins in ProFerm could be or become toxic, allergenic, disruptive to nutrition and biome function, and cause dysbiosis, making them potentially unsafe for human consumption.<\/p>\n\n\n\n<p>\u201cThat a nutritionally devoid substance composed primarily of fungal proteins never before consumed by humans could be labeled cow\u2019s whey is deeply concerning. Allowing this aberration into our food supply and classifying it as GRAS (generally recognized as safe) highlights the urgent need to reevaluate our regulatory framework for food,\u201d said Diana Reeves, GTFU Executive Director.<\/p>\n\n\n\n<p>The lawsuit, filed under the D.C. Consumer Protection Procedures Act, seeks to end Perfect Day&#8217;s deceptive marketing.
